Visualhole LLC ("Visualhole," "we," "us," or "our") operates Quest for Territory ("QFT"), including the game, website, forums and related online services (collectively, the "Service"). We respect the intellectual-property rights of others and expect the people who use the Service to do the same.
This policy explains how to tell us about material on the Service that you believe infringes your copyright, and how a user can respond if their material is removed. It is part of the Terms of Service and follows the notice-and-takedown procedure of the U.S. Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. § 512.
1. Reporting Infringement
If you believe material available through the Service infringes your copyright, send a written notice to our designated agent (section 5) that includes:
- a physical or electronic signature of the copyright owner or of a person authorized to act on the owner's behalf;
- identification of the copyrighted work claimed to have been infringed or, if several works are covered by one notice, a representative list of them;
- identification of the material claimed to be infringing and information reasonably sufficient for us to locate it, such as its web address, forum thread or in-game name;
- your contact information: name, postal address, telephone number and email address;
- a statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent or the law; and
- a statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.
Under 17 U.S.C. § 512(f), a person who knowingly and materially misrepresents that material is infringing may be liable for damages. If you are unsure whether material infringes your rights, consider seeking legal advice before sending a notice.
2. What We Do With a Notice
When we receive a notice that substantially meets these requirements, we will remove or disable access to the material expeditiously and make a reasonable effort to tell the user who posted it. We may give that user a copy of the notice, which may include your contact information.
3. Counter-Notice
If material you posted was removed and you believe it was removed by mistake or misidentification, you may send a counter-notice to our designated agent that includes:
- your physical or electronic signature;
- identification of the material that was removed and the location where it appeared before it was removed;
- a statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification of the material; and
- your name, address and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if your address is outside the United States, any judicial district in which Visualhole may be found), and that you will accept service of process from the person who sent the original notice or that person's agent.
We will send a copy of the counter-notice to the person who sent the original notice. Unless that person tells us, within 10 business days, that they have filed a court action seeking to restrain you from engaging in the infringing activity, we may restore the material within 10 to 14 business days after we received the counter-notice.
4. Repeat Infringers
We may, in appropriate circumstances and at our discretion, suspend or terminate the accounts of users who repeatedly infringe the copyrights of others or who are repeatedly the subject of valid infringement notices.
