These Terms are an agreement between you and Visualhole LLC ("Visualhole," "Operator," "we," "us," or "our"), which operates the Quest for Territory game and related online services.
These Terms of Service and End User License Agreement ("Terms") govern your access to and use of Quest for Territory ("QFT"), including the game client, game servers, website, forums, launcher, accounts and related online services (collectively, the "Service").
By creating an account, downloading or installing the game client, or accessing or using the Service, you agree to these Terms. If you do not agree, do not create an account, install the game, or use the Service.
1. Adults Only - 18+
You must be at least 18 years old to create an account or use Quest for Territory.
By creating an account or using the Service, you represent that you are at least 18 years old.
Quest for Territory does not permit accounts for minors, including with parental permission. If we determine that an account is being used by someone under 18, we may suspend or terminate the account.
The 18+ account requirement is a service eligibility rule and is separate from any ESRB, IARC, or other content rating that may apply to the game.
2. Your Account
You may be required to create an account to use the Service.
You agree to provide reasonably accurate information when required and to keep your login credentials secure.
You are responsible for activity occurring through your account. You may not sell, transfer, rent, or commercially trade your account unless we expressly permit it.
If you believe your account has been compromised, contact us as soon as reasonably possible.
We may restrict account names, character names, guild names, or similar identifiers that impersonate another person, infringe intellectual-property rights, are intended to deceive other users, or violate these Terms.
3. License to Use Quest for Territory
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable license to download, install and use the Quest for Territory game client for your personal, non-commercial entertainment.
You do not acquire ownership of the game client, servers, source code, game data, artwork, sounds, music, characters, world, lore, game mechanics, interfaces, or other QFT content merely by downloading or using the game.
Third-party or open-source components included with the game may be governed by their own licenses. Those licenses continue to apply to those components.
4. Cheating, Automation and Unauthorized Access
Unless we expressly authorize it, you may not:
- use bots, automation software, hacks, cheats, memory editors or unauthorized third-party programs to automate gameplay or obtain an unfair advantage;
- modify game memory or manipulate network traffic or game packets;
- exploit bugs, duplication errors, vulnerabilities or unintended game behavior for an unfair or disruptive advantage;
- interfere with, attack, overload or disrupt QFT servers or infrastructure;
- bypass authentication, access controls, bans or technical restrictions;
- access another user's account without authorization;
- scrape or extract non-public game or account data through unauthorized means;
- reverse engineer, decompile or disassemble the game except to the extent applicable law expressly permits such activity despite this restriction;
- create or operate an unauthorized server or service intended to emulate Quest for Territory;
- distribute modified QFT clients represented as official clients; or
- assist another person in doing any of these things.
If you discover a serious vulnerability or exploit, we encourage you to report it rather than abuse it.
We may investigate suspected cheating or abuse using server records, account information, gameplay data and other technical information as described in our Privacy Policy.
5. Real-Money Trading
Unless we expressly authorize it, accounts, characters, game currency, items, services, territory, guild assets and other in-game resources may not be sold, purchased, traded or exchanged for real-world money or other real-world value.
You may not operate gold-farming, power-leveling or similar commercial services using Quest for Territory without our permission.
6. Player Conduct
Quest for Territory is a competitive multiplayer game. Conflict between players is an intended part of the game.
Gameplay permitted by QFT's mechanics - including player-versus-player combat, territorial warfare, sieges, competition for resources and similar adversarial gameplay - is not, by itself, harassment or a violation of these Terms.
However, you may not use the Service to:
- make credible threats of real-world violence;
- reveal or solicit another person's private identifying information without authorization;
- stalk or engage in persistent targeted harassment outside legitimate gameplay;
- distribute malware or malicious links;
- commit fraud or impersonate QFT staff;
- engage in unlawful activity;
- distribute content that unlawfully infringes another person's intellectual-property rights; or
- interfere with another person's ability to use the Service through attacks on the Service itself.
Because access to QFT is restricted to adults, ordinary disagreement, competitive behavior, role-playing, PvP conflict or offensive gameplay outcomes will not necessarily constitute misconduct.
We may consider context when enforcing these rules.
7. Chat, Forums and User Content
The Service may permit you to submit character names, guild names, chat messages, forum posts, images, text or other material ("User Content").
You retain whatever ownership rights you otherwise have in original User Content you create.
By submitting User Content through QFT, you give us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, transmit, display and technically modify that content as reasonably necessary to operate, moderate, back up, maintain, provide, promote and market the Service. We may sublicense these rights to our service providers solely as necessary for them to help us provide the Service.
For example, this permits us to display a forum post, deliver a chat message, store a guild description, resize an uploaded image, or show a screenshot you shared publicly in news or promotional material about Quest for Territory.
You represent that you have the right to submit your User Content and that doing so does not unlawfully violate another person's rights.
We may remove, hide or restrict User Content that violates these Terms or applicable law. We may, but are not obligated to, monitor, review, record, moderate, remove or restrict User Content as permitted by applicable law. We do not endorse User Content submitted by users and are not responsible for its accuracy or reliability.
Communications made through the Service are not confidential and may be reviewed where reasonably necessary for moderation, security, anti-cheat, support or enforcement purposes, as described in the Privacy Policy.
Information posted publicly in forums, chat channels, character profiles, guild descriptions or similar public areas may be visible to other users. Do not post information you want to keep private.
8. Feedback and Suggestions
If you voluntarily send us suggestions, ideas, bug reports or other feedback about Quest for Territory, you permit us to use that feedback without payment or obligation to you.
This does not transfer ownership of unrelated material you create.
9. Characters, Items and Other Virtual Content
Accounts, characters, character progression, game currency, equipment, buildings, territory, guild assets and other virtual content are parts of the Service.
Except where we expressly state otherwise, they do not represent money, stored value, securities, ownership of server data or an entitlement to payment.
Your ability to access or use them exists only while the applicable Service and account remain available.
We may rebalance, modify, move, reset or remove virtual content as part of operating and developing the game.
10. Service Availability and Game Data
Quest for Territory is an online service. The availability, features, content, systems and technical requirements of the Service may change over time.
To the maximum extent permitted by applicable law, we do not guarantee:
- continuous or uninterrupted availability of the Service;
- any particular level of server uptime, performance or latency;
- permanent preservation of characters, accounts, progression, inventory, guilds, territory or other game data;
- continued availability of any particular server, feature, map, class, skill, item, mechanic or other content;
- continued operation of any particular server;
- compatibility with any particular hardware, software or prior version of the game; or
- continued operation of the Service for any particular period of time.
Maintenance, updates, technical failures, security incidents, database repairs or other circumstances may result in outages, rollbacks, resets, modification of game data or loss of game data.
We may modify, rebalance, reset, restore, migrate or remove game data as reasonably necessary to operate, maintain, secure or develop the Service. Characters, progression, items, currency, guilds, territory and other in-game content are features of the Service and are not guaranteed to be permanent or equivalent to real-world property or stored monetary value.
11. Modification or Discontinuation of the Service
We may add, remove, modify, suspend or discontinue features, content, systems, servers or other portions of the Service.
This may include changes to maps, classes, skills, characters, items, rules, server architecture, game mechanics, interfaces and technical requirements.
We may temporarily suspend or permanently discontinue all or part of the Service, subject to applicable law.
12. Suspension and Termination
You may stop using Quest for Territory at any time.
We may warn, restrict, suspend or terminate an account when we reasonably believe that:
- these Terms have been violated;
- cheating, exploitation or abuse has occurred;
- the account creates a security risk;
- continued access would interfere with the Service or other users;
- suspension or termination is required by law; or
- the Service or relevant portion of the Service is being discontinued.
Serious cheating, attacks against the Service, intentional exploitation, ban evasion or other serious violations may result in immediate termination.
We are not required to preserve characters, virtual items or other game data after an account is terminated.
13. Screenshots, Streaming and Community Content
Unless we state otherwise, you may create and share screenshots and video of ordinary Quest for Territory gameplay and may stream your gameplay through services such as YouTube or Twitch.
This permission does not give you ownership of QFT intellectual property and does not permit you to redistribute the game client, game assets, source code, music files or other extracted game content as standalone materials.
We may publish more detailed community-content guidelines in the future.
14. Third-Party Services and Links
Quest for Territory may rely on or link to third-party services such as hosting providers, authentication providers, forums, content-delivery networks, crash-reporting services, social-media platforms or other infrastructure.
Those services may have their own terms and privacy policies.
We are not responsible for independent third-party services that we do not control.
15. Intellectual Property
Quest for Territory and its original software, art, text, world, names, logos, sounds and other materials are owned by the Operator or their respective licensors.
Nothing in these Terms transfers QFT's intellectual-property rights to you.
If you believe content available through QFT infringes your copyright, follow our Copyright and DMCA Policy. For other intellectual-property concerns, contact legal@questforterritory.com with enough information for us to investigate the claim.
We may, in appropriate circumstances, suspend or terminate the accounts of users who repeatedly infringe the copyrights of others. Copyright notices and counter-notices are handled in accordance with our Copyright and DMCA Policy.
16. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUEST FOR TERRITORY AND THE SERVICE ARE PROVIDED "AS IS" AND "AS AVAILABLE."
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL EXPRESS, IMPLIED AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, COMPATIBLE WITH EVERY DEVICE, OR FREE FROM DATA LOSS.
WE DO NOT WARRANT THAT BUGS OR VULNERABILITIES WILL ALWAYS BE CORRECTED.
Some jurisdictions do not permit certain warranty disclaimers, so some of these limitations may not apply to you.
17. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE OPERATOR WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE OR THESE TERMS, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR ANY OTHER LEGAL THEORY, AND EVEN IF THE OPERATOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, INCLUDING LOSS OF GAME DATA, CHARACTERS, VIRTUAL ITEMS, PROFITS OR OTHER INFORMATION.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE OPERATOR'S TOTAL LIABILITY ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS, UNDER ANY LEGAL THEORY, WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID DIRECTLY TO THE OPERATOR FOR QUEST FOR TERRITORY DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR (B) US $100.
Nothing in these Terms limits liability that applicable law does not permit us to exclude or limit.
18. Indemnification
To the maximum extent permitted by applicable law, you agree to defend, indemnify and hold harmless Visualhole LLC and its members, managers, officers, employees, contractors, agents, licensors and service providers from and against third-party claims, demands, liabilities, damages, judgments, losses, costs and reasonable attorneys' fees arising out of or relating to (a) your User Content; (b) your violation of these Terms or applicable law; (c) your misuse of the Service; or (d) your infringement or violation of another person's rights.
Visualhole may assume control of the defense of any matter subject to indemnification by you, and you agree to cooperate reasonably with that defense.
19. Privacy
Our collection and use of personal information is described in the Quest for Territory Privacy Policy.
20. Changes to These Terms
We may update these Terms as Quest for Territory changes.
The current version will identify its effective or last-updated date.
For material changes, we may provide notice through the website, launcher, game, forum, email or account system and may require you to accept the revised Terms before continuing to use the Service.
Your continued use of the Service after revised Terms become effective constitutes acceptance where permitted by applicable law.
21. Governing Law and Forum
These Terms and any dispute arising out of or relating to these Terms or the Service are governed by the laws of the State of Ohio, without regard to conflict-of-law principles. Except where applicable law prohibits such a requirement, any such dispute shall be brought exclusively in a state or federal court of competent jurisdiction located in Ohio, and you consent to the personal jurisdiction of those courts.
Informal dispute notice. Before filing a lawsuit relating to these Terms or the Service, the party asserting the claim must send the other party written notice describing the claim and the relief requested, and allow at least 30 days for a good-faith attempt to resolve the dispute, except where applicable law prohibits this requirement or where immediate injunctive relief is reasonably necessary. Notices to Visualhole must be sent to legal@questforterritory.com.
22. Assignment and Transfer
You may not assign or transfer your rights under these Terms without our prior written consent.
We may assign these Terms or transfer all or part of the Service in connection with a merger, acquisition, reorganization, sale of assets, change of control or other lawful transfer, subject to applicable law.
23. General
Severability. If a provision of these Terms is determined to be unenforceable, the remaining provisions will remain in effect to the extent permitted by law.
Entire agreement. These Terms, together with any additional rules expressly incorporated into them, constitute the agreement governing your use of Quest for Territory.
No waiver. Our failure to enforce a provision of these Terms is not a waiver of our right to enforce it later.
Force majeure. We are not liable for any delay or failure to perform caused by circumstances beyond our reasonable control, such as Internet or hosting-provider outages, power failures, denial-of-service or other attacks, natural disasters, epidemics or governmental action.
Survival. Provisions that by their nature should survive the end of these Terms or of your account will survive it, including those concerning ownership and intellectual property, the license you granted for User Content already submitted, virtual content, disclaimers of warranties, limitation of liability, indemnification, and governing law and forum.
No third-party beneficiaries. These Terms do not create rights enforceable by anyone other than you and Visualhole.
24. Language and Translations
These Terms are written in English. We may provide translations for convenience. If a translated version conflicts with the English version, the English version will control, except to the extent applicable law requires otherwise.
A translation is intended to help users understand these Terms and does not create a separate agreement unless we expressly state otherwise.
